DriveSmart Warranty iRacing Giveaway Contest Terms and Conditions

1. Introduction

These Terms and Conditions apply to the iRacing Giveaway Contest ("Contest") sponsored by DriveSmart Warranty ("Sponsor"). Participation in the Contest constitutes the entrant's full and unconditional agreement to these Terms and Conditions.

2. Contest Period

Time Attack Competition: The Contest begins on November 15th at 8:00 AM GMT and ends on December 3rd at 8:00 AM GMT ("Contest Period").
Fantasy League Competition: Draft begins December 7th, 2023, with the races taking place up to January 18th, 2023.

3. Eligibility

The Contest is open to individuals who are 18 years of age or older at the time of entry and are legal residents of the United States of America.
Employees of the Sponsor, affiliated companies, and their immediate family members are not eligible to participate.

4. Contest Structure

Time Attack Competition: Participants will compete in a Time Attack using the Legacy NASCAR Truck Chevrolet Silverado 2008. Strict rules against unsportsmanlike conduct will be enforced.
Team Formation and Races: Winners of the Time Attack will be selected to join teams led by racing influencers. Team Draft Selection will occur on December 7th. Subsequent races will be held on December 14th, December 21st, January 4th, January 11th, and January 18th. The exact times for these events will be announced in advance.

5. Prizes

Team Championship Prize: The total prize for the Team Championship is $3,500, with each team member and the Influencer Coach receiving $500 each.
Individual Champion Prize: The individual champion from the Influencer team will receive an all-inclusive trip to the Daytona Race, including flights, hotel accommodations, and VIP Passes for the Champion and a guest. The Influencer Coach will also receive the same package for themselves and a guest.

6. Prize Conditions

Prizes are non-transferable and no substitution will be made except as provided herein at the Sponsor’s discretion.

7. Compliance with Laws

This Contest is subject to all applicable federal, state, and local laws and regulations. Void where prohibited or restricted by law.

8. General Conditions

Sponsor reserves the right to cancel, suspend, and/or modify the Contest if any fraud, technical failures, or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Contest, as determined by Sponsor in its sole discretion.
By participating, entrants agree to be bound by these Official Rules and the decisions of the Sponsor, which are binding and final on matters relating to this Contest.

9. Data Protection

Information collected from entrants is subject to the Sponsor’s Privacy Policy.

10. Limitation of Liability

DriveSmart Warranty and its affiliates, officers, directors, employees, agents, and licensors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your access to or use of or inability to access or use the contest; (b) any conduct or content of any third party related to the contest; (c) any content obtained from the contest; or (d) unauthorized access, use, or alteration of your transmissions or content.

11. Indemnification

By entering the Contest, participants agree to indemnify, defend, and hold harmless DriveSmart Warranty and its affiliates, officers, directors, employees, agents, and licensors from any and all claims, liabilities, expenses, and damages, including reasonable attorneys' fees and costs, made by any third party related to or arising out of (a) their participation in the Contest, (b) their violation of these terms, (c) their violation of any rights of another person or entity, or (d) their negligent or willful misconduct.

12. Dispute Resolution and Choice of Law

This Contest is governed by the laws of the United States and the state in which the Sponsor is headquartered, without respect to conflict of law doctrines. As a condition of participating in this Contest, participants agree that any and all disputes that cannot be resolved between the parties and causes of action arising out of or connected with this Contest shall be resolved individually, without resort to any form of class action, exclusively before a court located in the state of the Sponsor’s headquarters.

13. Publicity

Except where prohibited, participation in the Contest constitutes each winner’s consent to the Sponsor’s and its agents’ use of the winner’s name, likeness, photograph, voice, opinions, and/or hometown, and state for promotional purposes in any media, worldwide, without further payment or consideration.

14. Severability

If any provision of these Terms and Conditions is declared or found to be unlawful, unenforceable, or void, such provision will be ineffective only to the extent that it is found unlawful, unenforceable, or void, and the remainder of the provision and all other provisions shall remain fully enforceable.

15. Litigation

Any and all litigation arising from this Terms of Service will venue in Ocean County, New Jersey.

A VSC is not a warranty but provides repair coverage for your vehicle after your manufacturer’s vehicle warranty has expired. The VSC contract is with you and the vehicles owner and the VSC provider or administrator that will state what is covered in each plan.
